that the u.s. government can order the killing of american citizens if they are believed to be senior operational leaders of al-qaeda or an associated force -- here's the key line -- even if there is no intelligence indicating they are engaged in an active plot to attack the united states. so that policy is that we believe justice department is saying it is perfectly legal to use drones, not just to go out and kill people that we think might some day plan an attack against the united states who are not friendly to the united states. but also to kill americans anywhere on the planet whom we think are traitors or may some day, plan something against the united states even if there is no evidence that they are now engaged in an active plot. raises the whole question about drone warfare. i'm torn about it because it's a different kind of warfare. i mean, certainly, i would like to know what you think about this. 1-866-55-press. the problem i believe is we've got this technology. we are using it. we are using it more than anybody has ever used it before. i mean i forget how many -- you kno

the surge worked, what it did was extract the united states from a war that senator hagel believes the u.s. never should have been in, so he didn't sort of have that kind of strong push back. i think that truck made a very good point about what kind of sway he is going to have in congress. you know, the calculation of having a republican defense secretary as it was when bob gates remained as defense secretary for the first two years of the obama administration was to have someone there with the credibility to say, you know, this old cold war system can die. we don't need it. we can cut the budget here and put the money in cyber or put the money in some other activity that the united states considers relevant pursuing terrorists. right now it's not clear that he has enough juice with his own party that any of those arguments would necessarily work. i think that the white house has to be wondering did they buy the kind of authority from him and the kind of bipart sfwlan approach that they had hoped for? >> david, thank you very much. chuck, before i let you go, we've about the to talk about

: it appears the questions on brennan go directly to the u.s. policy on drones. we had rand paul on yesterday, the senator from kentucky. he is adamant that he will not allow brennan to go forward unless he answers a simple question. and that is, whether or not it is u.s. policy and u.s. law to use a drone over american skies and target americans here at home. what is your view on that? >> well, bottom line, i think senator paul has every right to have his questions answered. you're putting someone in a position in the cia that obviously is going to be making decisions that affect everyday americans not only here but abroad. he has that right to have those questions answered. we need to have a full disclosure from the administration as to what the policy is going to be. listen, i don't have a problem when somebody leaves their citizenship at the door and they're overseas and they have taken up arms against the united states of america. and they clearly are trying to hurt americans not only here but abroad, to use drones. i've been public on that already. the question comes what about here in
